1. Introduction and Acceptance
First Call Handyman LLC ("Company," "we," "us," or "our"), operating in the State of Iowa, provides professional handyman services including but not limited to plumbing, electrical work, general repairs, painting, carpentry, renovations, and specialty services. These Terms and Conditions ("Terms") govern all services provided and constitute a binding agreement between First Call Handyman LLC and all clients ("Client," "you," or "your").
By requesting a free estimate, scheduling a service appointment, using our AI voice/chat agent (Sophie), engaging with our SMS communication system, or accepting our services in any form, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. Estimates and Pricing
2.1 Free Estimate Policy
All estimates for services are provided free of charge with no obligation to hire First Call Handyman LLC. Estimates are valid for thirty (30) days from the date of issue unless otherwise specified in writing.
2.2 Pricing Structure
Our pricing is determined on a project-by-project basis and depends on the nature, scope, and complexity of the work required. Pricing may be structured as:

⢠Combination labor and material rates
All pricing information will be provided in writing during the estimate consultation. We believe in fair and transparent pricing with absolutely no hidden fees.
2.3 No Verbal Quotes
Verbal estimates or quotes provided during phone consultations are non-binding and subject to change upon in-person inspection. Only written estimates provided by First Call Handyman LLC personnel are binding.
2.4 Additional Work
Any work not specifically outlined in the written estimate is considered additional work. Additional work requires written authorization and a separate estimate before proceeding. The Client will be notified immediately if additional work is discovered and will not be performed without written approval.
2.5 Material Pricing
First Call Handyman LLC provides high-quality, durable materials sourced from trusted suppliers as part of project estimates unless otherwise agreed. Clients may opt to purchase and provide their own materials; in this case, labor-only estimates will be provided. First Call Handyman LLC is not responsible for quality issues related to client-provided materials.
3. Deposits and Payment Terms
3.1 Deposit Requirements
⢠Projects under $1,000: No deposit required unless otherwise negotiated.
⢠Projects $1,000 and above: A fifty percent (50%) deposit is required to secure the project and book the service appointment. A signed contract must accompany the deposit.
Deposits are non-refundable if the Client cancels within twenty-four (24) hours of the scheduled appointment start time. See Section 3.4 for cancellation details.
3.2 Accepted Payment Methods
First Call Handyman LLC accepts the following forms of payment:

We do not accept checks. Payment must be made in full before work is considered complete unless otherwise agreed in writing.
3.3 Payment Processing
Deposits and final payments are processed through third-party payment processors (Zelle, CashApp, Venmo, PayPal, Square, and Square payment terminals). By using these services, you understand and accept:

⢠Processing times vary by method (typically 1-5 business days)
⢠First Call Handyman LLC is not responsible for delays caused by third-party processors or banks
⢠All transaction disputes must be handled directly with the payment processor
3.4 Cancellation and Refund Policy
Client-Initiated Cancellations
⢠Cancellation more than 24 hours before appointment: Full refund of deposit (minus 3-5% processing fee) according to the timeline in Section 3.4(b).
⢠Cancellation within 24 hours of scheduled start time: $150 cancellation fee will be charged to cover wasted time, return of materials, and lost revenue. The remaining balance will be refunded according to the timeline in Section 3.4(b).
⢠No-show (Client fails to be present at scheduled appointment time): Cancellation fee of $150 applies, plus deposit is forfeited.
Refund Timeline
All refunds are processed according to the following timeline:
⢠3-5 business days from date of refund request for payment to be received by First Call Handyman LLC
⢠3-5 business days for processing the refund through payment processor
⢠3-5 business days for the bank/payment service to refund to Client's account
Total refund timeline: Minimum 9 business days to maximum 15 business days from request date.
Refunds will be issued to the original payment method. First Call Handyman LLC is not responsible for delays caused by third-party financial institutions.
Deposits for Projects Over $1,000
Fifty percent (50%) deposit is refundable if Client cancels with proper notice (see above). However:
⢠The deposit is non-refundable if Client cancels within 24 hours of scheduled start time
⢠A $150 cancellation fee applies for same-day cancellations
⢠The remaining deposit (if any) will be refunded per the timeline in Section 3.4(b)
3.5 Invoicing
A detailed invoice will be provided at project completion outlining all work performed, materials used, and labor costs. Payment in full is due before our team departs the Client's location unless a payment plan has been pre-arranged in writing.
4. Service Area and Trip Fees
4.1 Primary Service Area (Free Service)
First Call Handyman LLC provides free estimates and service with no additional trip fees within the Blue Outlined Service Area on our service map, available at https://www.firstcallhandyman.pro. This area includes but is not limited to: Des Moines, Clive, Ankeny, West Des Moines, Pleasant Hill, Altoona, Johnston, Urbandale, Windsor Heights, Norwalk, and surrounding communities in the Greater Des Moines Area.
4.2 Extended Service Area (Trip Fee Required)
For residential projects located within the Red Outlined Service Area but outside the Blue Outlined Area:
⢠Trip Fee: $75
⢠Discretion: This trip fee may be waived at the discretion of First Call Handyman LLC. Clients should request waiver consideration during estimate scheduling.
For commercial projects located within the Red Outlined Service Area but outside the Blue Outlined Area:
⢠Trip Fee: $75 for initial estimate consultation
⢠Commercial Hourly Rate applies: See Section 7.2 for commercial pricing
4.3 Outside Extended Service Area (Case-by-Case Evaluation)
Projects located outside the Red Outlined Service Area are evaluated on a case-by-case basis by First Call Handyman LLC management. Trip fees will be determined based on:
⢠Distance from our primary service location
⢠Scope and duration of the project
⢠Current service demand and scheduling
⢠Special circumstances
First Call Handyman LLC does not automatically decline projects outside our standard service area. All inquiries are reviewed, and we welcome consultation requests. Trip fees will be disclosed before any estimate appointment is scheduled. Refer to our website service area map at https://www.firstcallhandyman.pro for current service area information.
4.4 Service Area Verification
During booking, the Client's address will be verified against our service area map. If the address falls outside the Blue Outlined Area, the applicable trip fee (if any) will be disclosed before the estimate appointment is confirmed.
5. Insurance and Liability
5.1 First Call Handyman LLC Insurance Coverage
First Call Handyman LLC carries comprehensive general liability and contractors' errors & omissions insurance coverage. Our current insurance policies provide:
⢠General Liability Coverage: $1,000,000 per occurrence / $2,000,000 aggregate
⢠Contractors E&O Coverage: $1,000,000
⢠Insurance Carrier: State National Insurance Company, Inc.
Our Certificate of Insurance, W9 and WWC is available upon request. First Call Handyman LLC is fully licensed and insured to operate in the State of Iowa.
5.2 Liability Responsibility for Employee-Performed Work
All work performed by First Call Handyman LLC employees is covered under our company insurance policy. If Client property is damaged during work performed by First Call Handyman LLC employees, liability claims should be directed to First Call Handyman LLC, and we will work with our insurance carrier to address the claim.
5.3 Liability Responsibility for Subcontractor-Performed Work
If work is performed by a subcontractor hired by First Call Handyman LLC, the subcontractor's insurance is the primary responsible party for any damage or injury caused by that subcontractor. The Client should verify that the subcontractor carries adequate insurance before work begins. First Call Handyman LLC will provide subcontractor insurance information upon request.
5.4 Pre-Existing Conditions and Client Responsibility
First Call Handyman LLC is not responsible for:
⢠Pre-existing damage, defects, or structural conditions discovered during our work
⢠Damage caused by normal wear and tear
⢠Damage caused by Client negligence or misuse of completed work
⢠Issues arising from Client-provided materials or specifications
⢠Interference with work in progress by Client or third parties
5.5 Third-Party Liability
If Client's injury or property damage is caused by Client negligence, failure to follow safety instructions, or misuse of the work area, the Client assumes full liability. The Client is responsible for maintaining homeowners or commercial property insurance to cover such incidents.
5.6 Claim Notification and Process
Any claim for damage, injury, or alleged negligence must be reported to First Call Handyman LLC in writing within fourteen (14) days of the incident. Contact information:

All damage claims require an on-site assessment. If an in-home visit is required by First Call Handyman LLC personnel to assess and evaluate a claim, a $50 trip charge will apply. This fee is waived if First Call Handyman LLC is found responsible for the damage.
6. Warranty and Guarantee
6.1 One-Year Craftsmanship Warranty
First Call Handyman LLC warrants all labor and craftsmanship for a period of one (1) year from the project completion date. This warranty covers defects in workmanship and guarantees that work is performed in a professional and competent manner using industry-standard practices.
6.2 Warranty Scope
The one-year warranty covers:
⢠Labor and Craftsmanship Only: The warranty applies exclusively to the quality of work performed and labor provided by First Call Handyman LLC.
Material defects are not covered under warranty. Clients purchasing materials provided by First Call Handyman LLC may pursue claims directly with material manufacturers under manufacturer warranty terms. First Call Handyman LLC will facilitate referrals to manufacturers upon request.
6.3 Warranty Exclusions
The one-year warranty does not cover:
⢠Normal wear and tear
⢠Changes in appearance due to weathering or environmental factors (paint fading, stain changes, etc.)
⢠Damage caused by Client misuse, negligence, or failure to follow maintenance instructions
⢠Damage caused by acts of nature, water damage, mold, or environmental factors
⢠Changes or modifications made by Client or third parties after completion
⢠Failure due to Client's inability or refusal to maintain the completed work
⢠Damage from pre-existing structural or foundational issues
6.4 Callback Service and Warranty Claims
If Client believes work does not meet industry standards within the one-year warranty period, Client must contact First Call Handyman LLC immediately:

First Call Handyman LLC will assess the claim and, if valid, will perform callback work to remedy the defect at no additional cost. If a site visit is required to assess a warranty claim, a $50 trip charge applies. This fee is waived if the defect is confirmed to be the result of our workmanship.
6.5 Warranty Period and Expiration
The one-year warranty period begins on the project completion date. After one (1) year, warranty coverage expires. However, First Call Handyman LLC is committed to customer satisfaction and may address concerns beyond the warranty period at our discretion.
7. Service Terms and Commercial Pricing
7.1 Residential Service Terms
For residential clients, pricing, availability, and terms are determined during the estimate consultation and documented in the signed contract. Standard residential service includes:

7.2 Commercial Service Terms and Pricing
Commercial clients receive specialized service and pricing. All commercial projects require professional invoicing with receipts, labor and total material costs. No contract is required before work begins unless otherwise negotiated.

⢠Within Blue Outlined Service Area (Free Service Area): No trip fee
⢠Within Red Outlined Service Area (Extended Area): $75 trip fee
⢠Outside Red Outlined Service Area: $150 to $225+ trip fee (determined case-by-case)
Commercial Hourly Labor Rates:
All rates are per technician (Lead Tech or Assistant Tech) and include labor only. Materials are billed separately.
Standard Business Hours and Weekends

⢠Assistant Technician: $125/hour
After-Hours Service (Outside 6 AM - 9 PM Standard Hours)
⢠Lead Technician: $225/hour

⢠Minimum charge: Two (2) hours
Emergency Service Calls (Nights, Holidays, Weekends Beyond Standard After-Hours)

8. Service Scheduling and Appointments
8.1 Appointment Scheduling

First Call Handyman LLC uses an AI-powered assistant called "Sophie" to help schedule estimates and answer service questions. By interacting with Sophie, you acknowledge:
No Profanity in AI Interactions
Sophie is designed for professional communication. Use of excessive profanity or abusive language will result in immediate termination of the chat/call and possible referral to human support for follow-up.
Data Collection and Privacy
Sophie collects the following information during interactions:

⢠Service address and project description
⢠Preferred appointment dates/times
⢠Any special project requirements
This information is used solely for scheduling purposes and service delivery. See Section 9 for complete privacy policy.
Call and Chat Recording
First Call Handyman LLC records and stores:

These recordings and transcripts are maintained for quality assurance, service improvement, and dispute resolution. By using Sophie's voice or chat services, you consent to being recorded and your data being stored.
8.3 Appointment Confirmation
Once an appointment is scheduled, you will receive confirmation via:

8.4 Appointment Rescheduling
If you need to reschedule an appointment:

8.5 Client Presence During Service
⢠Residential appointments: Client presence is recommended so our technician can discuss scope and expectations directly.
⢠Commercial appointments: A facility manager or authorized decision-maker must be present to
approve additional work and authorize final payment.
8.6 Project Access and Preparation
Client should ensure:
⢠Work area is accessible and clear of obstacles
⢠Any pets are secured in a separate room
⢠Keys or gate codes are provided if we cannot access the property
⢠Utilities (water, electricity) are accessible if needed for the project
⢠Previous work area is prepared per technician instructions
9. Privacy and Data Protection
9.1 Information We Collect
When you request a free estimate, schedule an appointment, or interact with Sophie (AI assistant), we collect:

9.6 Information Security
While we take reasonable precautions to protect your information, no online transmission or storage system is 100% secure. First Call Handyman LLC is not liable for unauthorized access to information due to factors beyond our control.
10. Work Limitations and Exclusions
10.1 Services Not Provided
First Call Handyman LLC does not perform the following work:
Structural Work

⢠Load-bearing wall removal or modification
⢠Major roof repair or replacement (beyond small patches)
⢠Replacement of structural beams or supports
⢠Remediation of structural settling or damage
Structural work requires licensed structural engineers and is outside our scope.
Specialized Licensed Work (Case-by-Case Evaluation)
The following services are evaluated on a case-by-case basis depending on project scope and local permit requirements:

10.2 Permits and Compliance

⢠If unforeseen code violations are discovered, additional costs may apply
⢠Clients may request that First Call Handyman LLC cease work if code non-compliance is discovered
10.3 Materials and Specifications
First Call Handyman LLC uses high-quality, durable materials from trusted suppliers. However:
⢠Material selections shown during estimates are subject to availability
⢠Substitutions of comparable quality may be made if specified materials are unavailable
⢠Client will be notified of any substitutions before work proceeds
⢠Special-order or custom materials may extend project timelines
11. General Conditions
11.1 Weather and Conditions
First Call Handyman LLC reserves the right to suspend work if:
⢠Weather conditions make work unsafe or impossible
⢠Unsafe structural conditions are discovered
⢠Work conditions prevent professional-quality results
⢠Client's property is in a condition that poses safety risks
Suspended work will be rescheduled at the earliest available time. No charges accrue for suspended time.
11.2 Changes and Modifications During Project
If Client requests changes to the agreed scope of work during the project:

⢠A new estimate will be provided for the additional work
⢠Written authorization is required before proceeding
⢠Additional costs will be charged according to the new estimate
11.3 Assumption of Risk
By hiring First Call Handyman LLC, the Client assumes all risks associated with:
⢠The work being performed in the Client's home or property
⢠Contact with Client's pets, children, or other occupants
⢠Exposure to existing conditions in the Client's property (dust, allergens, mold, etc.)
⢠Any injury to Client or third parties during work (excluding injury caused by our negligence)
11.4 Access and Cooperation
The Client agrees to:
⢠Grant First Call Handyman LLC access to all work areas
⢠Keep children and pets safely away from work areas
⢠Provide necessary utilities (electricity, water, etc.) for project work
⢠Not interfere with work in progress
⢠Follow all safety instructions provided by our technicians
12. Dispute Resolution and Governing Law
12.1 Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Iowa, without regard to conflict of law principles. All disputes shall be resolved in accordance with Iowa law.
12.2 Informal Resolution
Before initiating formal legal action, both parties agree to attempt informal resolution of disputes:

12.3 Limitation of Liability
First Call Handyman LLC's total liability for any claim arising out of these Terms or the services provided is limited to the total amount paid by Client for the specific project that is the subject of the claim. In no event shall First Call Handyman LLC be liable for:

⢠Loss of profit, revenue, data, or use

12.4 Liability Cap for Third-Party Claims
Third-party claims (property damage, injury to non-Clients) are governed by First Call Handyman LLC's insurance policies and Iowa law. Recovery is limited to the applicable insurance policy limits ($1,000,000 General Liability).
13. Modifications to Terms and Conditions
First Call Handyman LLC reserves the right to modify these Terms and Conditions at any time. Changes become effective upon posting to our website. Continued use of our services after modifications constitutes acceptance of the modified Terms.
14. Entire Agreement
These Terms and Conditions, together with the written estimate and signed contract, constitute the entire agreement between the Client and First Call Handyman LLC regarding the services provided. No verbal promises, representations, or agreements supersede these written Terms.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, or if not possible, it will be severed. The remaining provisions will remain in full force and effect.
